Yves on the plane, off the plane, back in detention (Posted 04/01/10) Just a quick message to say, that after much trial and tribulations, Yves got a barrister and lawyer to assist in securing an injunction against this 3rd removal.... Third attempt to remove Yves Yitgna Njitchoua
This will be the third attempt to remove Yves, the most recent attempt on 17th December, never took place! According to the immigration summary, the removal was cancelled due to third party disruption. Yves has no clue what that means...the escorts in the van got a call from their boss to say the to return him to the detention centre, but then when back, Manchester UKBA stated they should take him to the airport again (but it did not happen as there was not enough time to prepare again for his removal for that flight). Please urge Home Secretary Alan Johnson MP to cancel the planned removal and to release Yves immediately so he can be back in his local community where he belongs. After his contributions to UK migrant and host community, as well as his political activities here and in Cameroon, time spent here, good character and medical issues - it is time for UKBA to consider granting Yves the right to settle here under the legacy status programme rather than condemning him to the great risk of being persecuted in Cameroon. Yves Yitgna Njitchoua Yves has been served with new Removal Directions (RDs) for the 4th January 2010. Yves did fax over his MLR to UKBA before his removal of 17/12/09 - I have sent by recorded delivery this week the photos to support his MLR. He has not received any decision on these submissions of his medical issues - and on 17/12/09, UKBA had no proper UK/ EU / Cameroonian travel documents valid for travel (it was a sheet of paper with his photocopied picture with UKBA heading) Nor was he issued the paper copy of his removal notice before. He has been given the removal notice for 4/1/10 this time though. He is without a lawyer as Hani at Fadiga is unable to assist with anything until after 8 Jan. Yves has nobody able to fund him further with a private lawyer now. The MP at Colnbrook IRC did try to speak with Phil Woolas but was told that there was nothing new to the case - yet there is, the medical report which UKBA are not giving consideration to at all. He should be allowed time to present these medical evidences - Yves cannot explain why the previous lawyer did not submit that report before Judicial Review in 2009, but he thought it had been in, and when he learnt it had not, he immediately sent it to UKBA before the removal plan of last week. We shall see how it goes, and hope for a Christmas good news for Yves with this removal plan..He did try rule 39 before and it got refused...but think we will try it again this time if possible. Geraldine Agbor "G M" <g_macv@yahoo.co.uk> Yves Yitgna Njitchoua ~ Still here, back in detention (Posted 18/12/09) Yves Yitgna Njitchoua Belongs to Manchester Yves Yitgna Njitchoua a national of Cameroon and resident of Manchester, is currently detained in Colnbrook IRC and due to be forcibly removed from the UK on Kenya Airways flight KQ101 on Thursday 17th December 2009 at 19:00. This will be the second attempt to remove Yves, a previous attempt in November 2008 failed after vigorous campaigning. Home Office on 20/11/08 issued a letter stating their reasons for refusing to grant asylum. Home Office also claim that his political activities in UK as SDF and CDC regional co-ordinator / activist and also in Cameroon do not put him at risk of being targeted by the authorities on return to Cameroon. Immigration authorities in UK also dismiss evidence provided by CDC UK-based leadership, saying it is neither objective nor impartial, and as such cannot be relied on as credible evidence in this case. However a judge previously stated they accept that Yves had been arrested and detained and escaped as claimed in his account about his problems in Cameroon forcing him to flee. Yet Home Office dismiss his claim saying that it is not accepted that being in “attendance at a demonstration in this country does not give rise to a reasonable fear of persecution” on return to Cameroon. Despite the constitution and laws of Cameroon prohibiting the practice of torture, or other cruel, inhuman or degrading treatments, according to US Department of State Human Rights Report 2008 (published 25/2/09) however, "there were credible reports that security forces tortured, beat, and otherwise abused prisoners and detainees, including demonstrators and a human rights worker arrested during the February riots. The government rarely investigated or punished any of the officials involved." Yves has submitted new evidences to show he has been an active registered member of SDF, and that he has been actively political for CDC group in UK . Yves has medical issues stemming from his experiences of being detained and abused in Cameroon, and also from the stress endured to date through the UK asylum system. He has been here for more than 4years now - he has tried to keep himself busy and active in his local community in Manchester area where he is known to various action groups. He was also involved in organising publicity for demonstrations against deportations to Cameroon, the most recent one being 4th September 09. He is terrified of being returned to Cameroon where he suffered torture and detention due to his political associations and activities.
