Isahq is a young man who is originally from Afghanistan but who has lived in Bolton for 6 years. He is thoroughly integrated into the British way of life. He is a Shia Muslim of Hazara ethnicity. He claimed asylum because of his fear of persecution due to his ethnicity and religion. He was a member of a group called Hazb-e-Harakat and worked as a bodyguard with this group. As a result of this he fears reprisals if he were returned to Afghanistan, a country which he left at the age of 16 years. He has no family living there now and no other friends or other support if he came under attack, which would make him extremely vulnerable. After his initial 2002 claim for asylum failed, he made a fresh claim in 2005 based on new evidence. Despite around 10 letters from his solicitor Diane Smith, at Ramsbottom Watson Solicitors, Blackburn, there was no reply from the Home Office about his case for a long time. Eventually his claim was refused, as was his appeal. He was arrested on January 6th 2008 and having been taken to four removal centres, was finally detained at Harmondsworth Immigration Removal Centre. He has been in a state of limbo since then. He is understandably despairing and feels very isolated. He did not access NASS support from 2005 onwards and has been living destitute, supported by his friends and a weekly food parcel from the Red Cross. Isahq has been keen to take advantage of whatever educational opportunities have been on offer and has attended ESOL classes and computer courses. He has played football for a local team. He is open to new ideas and has always been willing to explore new avenues and initiatives offered locally. Despite his hardship he remained involved in community based, voluntary activities such as Refugee Healthy Eating Project (a project which aims to integrate and educate refugees and local people working around healthy lifestyles), sewing classes (where he worked as a voluntary tutor) and the DeProSU community allotment, another local educational and integration project. He has been unstinting in his readiness to help others, whatever their ethnicity and has been as asset to the community. In his 15/02/08 determination, the adjudicator, Mr. J. Gillespie, wrote : There are undoubtable compassionate factors in his favour, arising out of his community work and selfless endeavour in Bolton and amongst deprived refugee and migrant person which compassionate factors are enhanced by the delay in decision to which the appellant has been subject" According to the Human Rights Watch World Report for 2007 Afghans face escalating violations of their human rights at the hands of a variety of abusers: the Taliban and other anti-government insurgent groups, including Islami and tribal militias, criminal groups and local warlords (many with government affiliations), and, increasingly, the Afghan government itself. The United Nations assessment of areas considered most dangerous and thus out of bounds for nearly all aid workers doubled in 2007 to cover one-third of Afghanistan. Violence and insecurity in 2007 was a bloodier year than any since the US-led forces ousted the Taliban in 2001.
