Swedish guidelines regarding sexual orientation

     Migration Board SwedenGuidelines for investigation and evaluation of asylum cases in which persecution based on given sexual orientations is cited as a ground.

ÊÊÊÊÊUpon instructions of the Government, the Migration Board (Migrationsverket) previously submitted a report regarding established practices and statistics regarding cases in which persecution due to various sexual orientations is cited as a ground, as well as guidelines for investigation and assessment of these cases. These guidelines are set forth below. The guidelines in Swedish are supplemented by an exhaustive reference list including international agreements, instructive court decisions in various countries, reports and organisations relating to this subject. This reference list, however, has not been included in this English translation of the guidelines.

ÊÊÊÊÊThe guidelines have been formulated in close collaboration with representatives of HomO (The Ombudsman against Discrimination because of Sexual Orientation), the National Institute of Public Health and RFSL (Swedish Federation for Lesbian, Gay, Bisexual and Transsexual Rights). In addition, the Board has also been in contact with organizations such as UNHCR and Amnesty.
