Asylum
decisions in the wrong hands
In a letter to The Times, published on the
13th November 2002, Malcolm Smart, Director of the Medical Foundation for
the Care of Victims of Torture, argues that 30 years of immigration legislation
has only distorted the asylum system. And questions wether there is justice
within the system.
"A system in which the initial
decision-makers dwell in the same department with those who seek to deter,
detain and remove raises profound questions about natural justice. The Secretary
of State acts as both prosecutor and judge in his own court. "
