Farrokh Shiri - Must Stay Campaign - Very good news - is now realy very good news

Today Shiri heard that the Secretary of State's application for leave to appeal the Adjudicator's decision in his favour from the Cardiff Hearing of 18th September 2002. has been refused by the Immigration Appeals Tribunal (IAT).

Only a HO application for Judicial Review could now overturn that decision and his solicitor thinks this highly unlikely.

Farrokh Shiri - Must Stay Campaign - Very good news - not so good news

     Farrokh Shiri had his appeal under the Human Rights Act heard on the 18th September 2002 in Cardiff.

     On 23 October, he was notified that his appeal had been successful. The Adjudicator stated in para 23 of his Determination "The position is this. It is not possible to say what will happen to the appellant if he is returned to Iran. However having considered carefully all the objective evidence and the judgements of the Immigration Appeal Tribunal in the cases of Dorodian and Khoshkam, I am satisfied that there is a real risk of the appellant suffering ill-treatment contrary to Article 3 of the ECHR if returned to Iran. It does not seem to me to be possible to take any other view when returning an apostate to a country where the penalty for apostasy is death".
      

     The Home Office had 10 working days to appeal the decision. On the 6th November Farrokh, was notified by the Immigration Appeal Tribunal that the Home Office had applied for leave to appeal against the Adjudicator's decision on 31 October, only notice of intent to appeal, no grounds as yet.
 
    Obviously, Shiri was over the moon with the decision but has been knocked back by the Home Office appeal.
